These Terms of Service ("Terms") are a binding agreement between you and HomeTrust App LLC ("HomeTrust," "we," "us," or "our"), a Florida limited liability company with its principal place of business at enoguera@hometrust.app (registered agent). They govern your access to and use of the website located at hometrust.app, our mobile applications, and all related services (collectively, the "Platform").
By creating an account, browsing the Platform, or otherwise using it, you agree to these Terms. If you do not agree, do not use the Platform.
If you are using the Platform on behalf of a business, you represent that you have authority to bind that business, and "you" refers to both you and the business.
HomeTrust is a technology platform and marketplace facilitator. We connect homeowners ("Homeowners") seeking home-related services with independent businesses that offer those services ("Businesses"). We provide search and discovery tools, business profiles, an informational Trust Score, in-platform messaging, quote and estimate tools, scheduling tools, and a review system.
HomeTrust does not perform home-services work. We are not a contractor, home-improvement company, or provider of plumbing, electrical, HVAC, roofing, landscaping, or any other service listed on the Platform. Businesses listed on HomeTrust are independent third parties, not employees, agents, franchisees, or representatives of HomeTrust. See the Business Partner Agreement (Section 5 below) for the full terms governing that relationship.
HomeTrust is not a party to any agreement between a Homeowner and a Business. When a Homeowner and Business agree to a project — through a quote, an estimate, a scheduled appointment, or otherwise — that agreement is solely between them. HomeTrust does not draft, negotiate, countersign, enforce, insure, warrant, or guarantee that agreement or the work performed under it.
We do not guarantee that any Homeowner will contact, hire, meet with, or purchase services from any Business, or that any Business will respond to, accept, or complete work for any Homeowner.
You must be at least 18 years old and able to form a binding contract to create an account. You may register as a Homeowner or as a Business; each role carries additional terms below and, for Businesses, in the Business Partner Agreement.
You are responsible for the accuracy of the information in your account and for all activity that occurs under it. Keep your login credentials confidential. Notify us promptly at support@hometrust.app if you suspect unauthorized access.
We may suspend or terminate accounts as described in Section 16.
If you use the Platform as a Homeowner, you agree to:
HomeTrust does not guarantee the availability, pricing, quality, licensing, insurance status, or workmanship of any Business, and does not guarantee that any Business will complete work to your satisfaction. See Section 12 (Disclaimers) and Section 8 (Trust Score).
If you use the Platform as a Business, the Business Partner Agreement (a separate document, incorporated into these Terms by reference) governs your listing, conduct, and relationship with HomeTrust and applies in addition to these Terms. In the event of conflict between these Terms and the Business Partner Agreement on a matter specific to Businesses, the Business Partner Agreement controls.
Reviews, photos, project descriptions, messages, and other content you submit to the Platform ("Content") are governed by the Review & Content Policy (a separate document, incorporated into these Terms by reference). You retain all ownership rights in your Content — submitting it does not transfer that ownership to HomeTrust. By submitting Content, you grant HomeTrust a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that Content in connection with operating and promoting the Platform. You represent that you have the right to grant this license and that your Content does not infringe any third party's rights.
We do not create, verify the accuracy of, or endorse third-party Content such as reviews or messages, and are not responsible for it. See Section 12.
The Platform's messaging tools are provided to facilitate communication between Homeowners and Businesses about potential and active projects. You agree not to:
We may monitor, review, and, where necessary to enforce these Terms, investigate reports of abuse, or comply with law, access message content. We are not obligated to monitor messages and are not responsible for their content, which is solely the responsibility of the sender.
HomeTrust displays an informational Trust Score for Businesses, along with indicators such as "license verified" or "insurance verified."
The Trust Score is not a guarantee, certification, endorsement, warranty, or representation regarding the quality, safety, legality, reliability, or performance of any Business or its services. It is a proprietary, algorithmically generated score based on information available to HomeTrust at a given point in time, including information self-reported by the Business. HomeTrust does not assign a perfect score: the maximum attainable Trust Score is 98, reflecting that no platform can guarantee the future performance, conduct, or quality of an independent business.
Where the Platform indicates that a license, insurance policy, or other credential has been "verified," this means HomeTrust reviewed documentation submitted by the Business according to its verification process as of the date shown. It does not mean HomeTrust guarantees the credential remains valid, current, or accurate at any later date, and HomeTrust has no ongoing obligation to re-verify credentials except as it determines in its discretion.
Businesses may subscribe to paid tiers (currently "Core" and "Pro") for additional Platform features. Subscription pricing, billing cycles, auto-renewal, and cancellation terms are set out at checkout and in your account billing settings. Except where required by law or expressly stated at checkout, subscription fees are non-refundable, including for partial billing periods.
HomeTrust does not currently process payment for the underlying home-services work performed by a Business for a Homeowner. Any such payment is arranged directly between Homeowner and Business, outside the Platform's payment systems, unless and until HomeTrust states otherwise.
In addition to the role-specific obligations above, you agree not to:
We may investigate and take appropriate action, including account suspension or termination, and may report conduct to law enforcement where warranted.
The Platform, including its software, design, text, graphics, and the HomeTrust name and logo, is owned by HomeTrust or its licensors and protected by intellectual property law. Except for your own Content, you may not copy, modify, distribute, or create derivative works from the Platform without our written permission.
If you believe Content on the Platform infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our designated agent at support@hometrust.app, including: (a) a description of the copyrighted work; (b) the location of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement that the notice is accurate and, under penalty of perjury, that you are authorized to act; and (f) your physical or electronic signature. We will respond in accordance with the Digital Millennium Copyright Act, including removing or disabling access to material as appropriate and notifying the affected user, who may submit a counter-notice under § 512(g). Repeat infringers' accounts will be terminated.
THE PLATFORM AND ALL CONTENT, TRUST SCORES, LISTINGS, AND INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
HOMETRUST DOES NOT WARRANT THAT: (A) ANY BUSINESS IS LICENSED, INSURED, BONDED, QUALIFIED, OR LEGALLY PERMITTED TO PERFORM ANY SERVICE; (B) ANY WORK PERFORMED BY A BUSINESS WILL BE SATISFACTORY, SAFE, OR CODE-COMPLIANT; (C) ANY REVIEW, TRUST SCORE, OR OTHER INFORMATION ON THE PLATFORM IS ACCURATE, COMPLETE, OR CURRENT; OR (D) THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
HOMETRUST IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, REPRESENTATIONS, WARRANTIES, SERVICES, PRODUCTS, WORKMANSHIP, CONDUCT, PRICING, LICENSING, INSURANCE, PERMITTING, OR PERFORMANCE OF ANY INDEPENDENT BUSINESS LISTED OR PARTICIPATING ON THE PLATFORM, OR FOR THE CONDUCT OF ANY HOMEOWNER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMETRUST AND ITS MANAGERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING ANY DISPUTE, PROJECT, OR TRANSACTION BETWEEN A HOMEOWNER AND A BUSINESS, EVEN IF HOMETRUST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
HOMETRUST'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOMETRUST IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless HomeTrust and its managers, members, officers, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your Content; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e), if you are a Business, your provision of services, including any claim by a Homeowner relating to your work, licensing, insurance, pricing, or conduct (see also the Business Partner Agreement).
Please read this section carefully — it affects your legal rights.
14.1 Informal Resolution. Before filing a claim against HomeTrust, you agree to contact us at support@hometrust.app and attempt in good faith to resolve the dispute informally for at least 30 days.
14.2 Binding Arbitration. Except for claims that qualify for small-claims court or claims for injunctive relief regarding intellectual property or unauthorized platform access, you and HomeTrust agree that any dispute arising from or relating to these Terms or the Platform will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small-claims court.
14.3 Class Action Waiver. YOU AND HOMETRUST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
14.4 Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@hometrust.app within 30 days of first accepting these Terms, identifying your name, account, and intent to opt out.
14.5 Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration, and the remainder of this section remains in force.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, the Business Partner Agreement, or the Review & Content Policy; suspected fraud or illegal activity; risk to other users or to HomeTrust; or at our discretion to protect the integrity of the Platform. You may close your account at any time through account settings or by contacting us. Sections that by their nature should survive termination (including Sections 5, 11–14, and 17) will survive.
We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and, for material changes, provide additional notice (such as email or an in-app notice). Continued use of the Platform after changes take effect constitutes acceptance.
Governing Law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 14.
Venue. Subject to Section 14, exclusive venue for any dispute not subject to arbitration lies in the state courts located in Broward County, Florida, or the U.S. District Court for the Southern District of Florida, and you consent to personal jurisdiction there.
Entire Agreement. These Terms, together with the Business Partner Agreement, Privacy Policy, and Review & Content Policy, constitute the entire agreement between you and HomeTrust regarding the Platform.
Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Notices. We may provide notices to you via the email associated with your account or via the Platform. You may provide notices to us at support@hometrust.app or by mail to enoguera@hometrust.app.
If you enable text message notifications in your account settings, you consent to receive automated text messages from HomeTrust related to your account, including alerts that a message sent to you on the Platform has gone unread and reminders about upcoming appointments. Message frequency varies based on your account activity. Message and data rates may apply. You may opt out at any time by disabling text message notifications in Settings, or by replying STOP to any message we send; reply HELP for assistance. Consent to receive text messages is not required to use the Platform.
